Motor Bike Accidents and Push Bike Accidents Motor Cyclists have an especially poor safety record when compared to other road user groups. This is often not because of the way the motor cyclist is driving.
One of the main reasons for accidents with both push bikes and motor cycles is that other road users simply do not see them -their eyes focus only on other car/van/lorry users – despite the cyclist wearing the appropriate High Visibility clothing.
The Department of Transport ordered a report to be produced in 2004 and this report showed that although motor cyclists make up less than 1% of vehicle traffic their riders suffer 14% of total deaths and serious injuries on the roads. This report was 2004 and it is our belief that this figure has risen over the past years. It is also our belief this figure will continue to rise as our roads are more and more congested particularly at peak times.
In fact statistics produced as far back as 1999 showed that a motor cyclist was 28 times more likely to be killed or seriously injured on the roads in this country than other drivers of cars. In a survey of accidents during 1997-2002 it was found that accidents occurred because of the problem of the perception of other road users in that even very experienced drivers seem to have problems detecting approaching motor cycles and push bikes and many accidents occurred at junctions.
A Claim involving a motor cyclist and push bike cyclist should follow similar lines to that of pursuing an action for a car claim. However, there are very often more arguments on liability particularly if there were no witnesses to the accident. There are many cases where contributory negligence is alleged by the other driver which would result in a percentage of your claim being disallowed. We are experienced in dealing with arguments of contributory negligence and will advise you in this respect at the onset and throughout the case. Very often the injuries both physical and psychological are more serious for the motor cyclist and push bike rider.
As with other claims the amount of compensation you will receive will vary from claimant to claimant and this will depend on the injuries you have received and the prognosis for recovery. Each person’s circumstances are different. Compensation will be based according to the content of the medical report.
We are prepared to assess your case and explain the process to you of how your claim will be handled. We will explain the steps we will take to argue liability and thereon to consider the injuries, appoint the appropriate medical expert for you and consider the medical report carefully to ensure that you receive the amount of compensation you are entitled to.
Our personal injury department specialises in this work and you will benefit from their years of experience in dealing with cases similar to your own. We guarantee that the person who handles your case from the beginning will continue with the case through – your case will not be handled by several people.
If your case has reasonable prospects of success we will take the matter on under a No Win No Fee Agreement and you will receive 100% of compensation.
Be aware that it is important to contact a specialist lawyer as soon after the accident as possible in order to ensure that any evidence or witnesses are considered as soon as possible. Additionally the Statute of Limitations only allows claims for injuries to be brought before the courts within a three year period otherwise they may be time barred.
